Terms of Service

These Terms of Service govern access to and use of SmartQ. By using SmartQ, you agree to these Terms. SmartQ is a product of KeRoY Technologies OÜ.

1. Use of the Service

SmartQ provides crowd estimation, queue context, trip-planning support, routing context, live explore surfaces, SmartQ Display or wearable companion surfaces, and related travel information tools. SmartQ is intended for personal trip planning unless KeRoY Technologies OÜ approves another use in writing.

You may use SmartQ only in compliance with applicable law, these Terms, and any terms that apply to linked third-party services you choose to use.

2. Accounts and Premium Subscriptions

Some features may require an account, Premium subscription, or other entitlement. You are responsible for the information you provide, the security of your account access, and activity associated with your account.

Current SmartQ Premium products are App Store auto-renewing subscriptions. Weekly Premium renews weekly until canceled. Annual Premium renews annually until canceled. If annual pricing is shown as a monthly-equivalent amount, the full annual charge should also be clearly disclosed.

App Store subscription payments, billing, cancellation, and refunds are handled by Apple under Apple's terms. You can manage or cancel subscriptions through your Apple ID or App Store subscription settings. SmartQ may provide a Restore Subscription action to restore App Store subscription access.

SmartQ receives and stores only the subscription entitlement and transaction information needed to verify Premium access, restore subscriptions, prevent abuse or wrong-account subscription linking, and support users. SmartQ does not store payment card details.

3. User Submissions

If you submit reports, queue updates, ratings, comments, images, corrections, or other content, you represent that you have the right to share that content and that it does not violate law or third-party rights.

You give SmartQ a non-exclusive, worldwide, royalty-free license to host, store, display, moderate, analyze, and use your submissions to operate, protect, and improve SmartQ, including crowd estimates, queue context, moderation, trust signals, and aggregate product intelligence.

Reports, comments, queue estimates, votes, flags, and report photos may be visible to other users if submitted to public community features. Do not upload photos containing sensitive personal information unless necessary. SmartQ may remove content that is unlawful, abusive, spammy, misleading, harmful, or otherwise incompatible with the service.

4. Acceptable Use

  • Do not misuse, disrupt, overload, reverse engineer, or interfere with SmartQ.
  • Do not attempt unauthorized access to systems, accounts, APIs, or data.
  • Do not submit false, deceptive, abusive, illegal, or rights-infringing content.
  • Do not bypass rate limits, access controls, entitlement checks, or security protections.
  • Do not scrape, bulk extract, harvest, copy, cache, resell, redistribute, or rehost SmartQ content, data, estimates, routes, reports, or API responses.
  • Do not use SmartQ to build, train, validate, benchmark, or operate a competing product, dataset, model, API, or commercial service without written permission.

5. Data, Sources, and Accuracy

SmartQ combines source categories such as live signals, typical patterns, historical crowd patterns, public or operator-published information, user reports, queue/photo report evidence, visit signals, opening hours, weather context, events, routing context, privacy-conscious aggregates, and SmartQ estimates. Source availability varies by location and time.

Crowd levels, queue estimates, travel times, opening status, venue operations, transit service, and related information may be incomplete, delayed, inaccurate, unavailable, stale, or change rapidly. SmartQ is an informational planning tool, not a guarantee.

Queue/wait wording should be reserved for actual queue/wait evidence. Weather overlays and weather context are not observed crowd evidence. SmartQ should not present generated estimates as observed live facts.

Third-party names, data, maps, routes, trademarks, logos, and services remain the property of their respective owners. SmartQ does not claim ownership of third-party source data.

6. SmartQ Display and Companion Surfaces

SmartQ Display, /wearable, Live Activities, and supported display/wearable integrations are compact companion surfaces for display-safe trip, nearby, crowd, or queue guidance. They are not a full planner, admin surface, or independent report-authority surface.

Queue/photo report submissions from companion or wearable/display surfaces must still require sign-in and valid proximity/location checks where applicable.

7. Intellectual Property

SmartQ's original software, branding, design, text, scoring, generated plans, service features, reports, aggregate signals, and presentation are owned by KeRoY Technologies OÜ or its licensors and are protected by applicable intellectual property laws.

Except as expressly allowed by these Terms, you may not copy, reproduce, modify, publish, distribute, sublicense, sell, or exploit substantial portions of SmartQ without written permission.

8. Service Availability

SmartQ may change, suspend, or discontinue features at any time. Availability is not guaranteed, and service interruptions, maintenance, provider changes, App Store issues, or third-party outages may occur.

9. Disclaimer

SmartQ is provided on an "as is" and "as available" basis, without warranties of any kind to the maximum extent permitted by law. Do not rely on SmartQ for emergency, safety-critical, medical, legal, or financial decisions.

10. Limitation of Liability

To the fullest extent permitted by law, KeRoY Technologies OÜ shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for losses resulting from use of or inability to use SmartQ.

11. Changes to These Terms

SmartQ may update these Terms from time to time. Continued use of SmartQ after changes become effective constitutes acceptance of the revised Terms.
